I also wonder how uncommon it is to get sued by CC companies. Even tho some say its rare, if you visit online forums about credit card debt, there are usually many posts about people being sued.

While you are correct that they can sue you if they need a judgment, you are incorrect in that it is rare for them to sue. I have seen many cases online at Alameda County Superior Court and there are tons of collections lawsuits by MAJOR banks over some debts as small as $700. You ought to help people with affirmative defenses to combat the lawsuit because if they don’t answer, default judgments can be taken out.

A court can’t garnish your wages if you don’t get to speak for yourself. They must prove standing. Also, if you call a credit card company and agree to pay anything you are now in a binding verbal contract. Don’t agree to pay anything. That is why htey record the calls.

You brought up the point of phony personal service. We had a case where the server lied about personal service, a judgement arrived in the mail and even with a lawyer the judge refused to set aside the fraudulent judgment.

Does the amount of credit card debt increase the probability of being sued? Does the current economy increase or decrease the probablility of being sued? Does who the credit card is with determine how likely it is to be sued (some more aggressive than others)?
