This original credit card was a Providian card that has been acquired by 3 different banks over the last few year one being Chase(that card was paid off in full) I have received letters that state they can freeze my banking accounts,put a lien on my home & take my vechiles (one pd for) & another collection agency calls my home daily for the same card that i am being sued by Can i counter sue this firm for anything
For starters, if the last activity or last payment on that credit card was in 95, it is past the Statute of Limitations (SOL), the timeframe to bring lawsuit. Check your state: http://www.bcsalliance.com/y_debt_sol.html. If they sue, you can use the SOL as an affirmative defense.
Have you received an actual summons? Be sure to respond to that summons using the SOL and show up in court. Otherwise, they will win a default judgment.
Could it be that they already have a judgment against you? Judgments are good for a long time and can be renewed. There are collection agencies now that specialize in buying up old judgments and pursue collections. Since they are threatening attaching your bank account and liening property, it sounds like they do have a judgment.
If there is no existing judgment, you can just send the collection agency a certified, return receipt letter telling them to cease all contact as the debt is beyond the SOL and not valid. They have to stop contacting your and will probably just sell the debt to another zombie collector.
